Terms of Service

1. Overview

These Terms govern access to and use of Plotbook.io and all related services, applications, APIs, and data products (“Services”), operated by Plotbook LLC, a Delaware limited liability company (“Plotbook,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to these Terms.

2. Nature of the Service

Plotbook provides a prospect intelligence and property research platform that aggregates:

• Parcel and property data
• Mapping services
• Public and commercially licensed enrichment data
• AI-generated analysis

Plotbook does not originate most third-party data displayed on the platform. Data is obtained from licensed providers and public records.

3. Third-Party Data Providers & Vendor Attribution

The Services incorporate licensed or API-based data from third parties, including but not limited to:

• Parcel Data: Regrid
• Mapping & Geospatial Rendering: Mapbox
• Enrichment & Contact Intelligence: Apollo.io, RocketReach, Whitepages
• AI Processing: Google Gemini

These providers operate under their own terms, data licenses, and compliance frameworks.

Vendor Disclaimer

You acknowledge and agree:

• Plotbook does not guarantee the accuracy, completeness, timeliness, or reliability of third-party data.
• Plotbook is not responsible for errors, omissions, outdated records, mismatches, or inferred estimates.
• All enrichment data is provided “as available” from vendors.
• You must independently verify information before relying on it for legal, financial, marketing, or compliance purposes.

4. No Warranty of Data Accuracy

All data, including:

• Net worth estimates
• Ownership inference
• Contact details
• AI-generated summaries
• Business affiliations

are estimates or compiled data from third-party sources.

Plotbook makes no representations or warranties regarding:

• Accuracy
• Fitness for a particular purpose
• Deliverability of contact information
• Compliance of data with marketing laws

Use of data is at your sole risk.

5. Exported Data & User Responsibility

If you export, download, copy, scrape, or otherwise extract data from the platform:

• You are solely responsible for how that data is used.
• Plotbook is not liable for downstream use of exported data.
• Plotbook is not responsible for regulatory compliance in your outreach, solicitation, marketing, or fundraising activities.

You agree to comply with all applicable laws including:

• CAN-SPAM Act
• TCPA
• GDPR
• CCPA/CPRA
• State privacy and consumer protection laws
• Anti-harassment and anti-spam regulations

You assume full responsibility for legal compliance of outreach activities.

6. Acceptable Use & Vendor Compliance

You may not:

• Use the Services for unlawful harassment or discriminatory targeting
• Use data for credit, insurance, employment, tenant screening, or FCRA-regulated purposes
• Resell, sublicense, or redistribute platform data
• Circumvent vendor rate limits or technical safeguards
• Attempt to reverse engineer vendor integrations
• Use automated scraping beyond platform permissions

Violation may result in immediate suspension without refund.

7. AI Disclaimer

Plotbook integrates AI services powered by Google Gemini.

AI outputs:

• May contain inaccuracies
• May reflect incomplete third-party data
• Are probabilistic in nature
• Should not be relied upon as legal, financial, or compliance advice

You are responsible for reviewing and validating AI outputs before relying on them.

8. Subscription, Billing & Refund Policy

Billing

• Subscriptions are billed in advance on a recurring basis.
• You authorize automatic recurring charges.
• Fees are non-refundable except where required by law.

Refund Policy

Unless required by applicable law:

• No refunds for partial billing periods.
• No refunds for unused credits.
• No refunds after data has been accessed or exported.
• Enterprise contracts may have separate written refund provisions.

Chargebacks initiated without contacting support may result in account termination.

9. Intellectual Property

All software, UI, algorithms, workflows, proprietary scoring systems, and platform architecture remain the exclusive property of Plotbook LLC.

Data sourced from third-party vendors remains subject to their respective licenses.

You receive a limited, non-exclusive, non-transferable license to use the platform during your subscription term.

10. Confidentiality

Each party agrees to protect non-public business information received from the other party.

Plotbook does not claim ownership of proprietary data you upload.

11. No Sale of Proprietary User Data

Plotbook does not:

• Sell user-uploaded proprietary CRM data
• Share private uploaded contact lists
• License proprietary user-entered data to third parties

User-uploaded data is processed solely to provide the Services.

12. Indemnification

You agree to indemnify and hold harmless Plotbook and its officers, employees, contractors, and licensors from any claims arising from:

• Your use of exported data
• Your marketing or outreach activities
• Your violation of vendor terms
• Your violation of applicable laws
• Your misuse of AI outputs

13. Limitation of Liability

To the maximum extent permitted by law:

Plotbook's total liability shall not exceed the greater of:

• Fees paid in the prior 12 months, or
• $100

Plotbook is not liable for:

• Indirect damages
• Lost profits
• Regulatory fines
• Marketing penalties
• Data inaccuracy
• Third-party vendor outages
• AI output errors

14. Service Availability

Plotbook may modify, suspend, or discontinue portions of the Services at any time.

Vendor API interruptions do not constitute breach of contract.

15. Termination

We may suspend or terminate accounts for:

• Violation of Terms
• Abuse of vendor integrations
• Non-payment
• Regulatory risk exposure

Termination does not relieve accrued payment obligations.

16. Governing Law

Governed by the laws of the State of Delaware.

Disputes resolved via binding arbitration unless prohibited by law.
